1. Acceptance
By accessing or using Wisprs ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Wisprs provides AI-powered transcription for audio and video (speech-to-text), summaries, speaker identification, translation, and export in multiple formats (TXT, SRT, VTT, DOCX, JSON). The Service is offered in tiers: Free, Pro, Studio, Agency, and Enterprise.
2. Account
You must create an account to use the Service. We use Clerk for authentication (sign-in, sign-up, password reset). You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and update it as needed.
3. Use of the Service
You may use the Service to upload audio and video files, transcribe them, generate summaries and other AI-derived outputs, edit transcripts, and export in supported formats. You must use the Service in compliance with applicable laws and must not upload content that infringes others' rights, is illegal, or that you do not have the right to process. We may suspend or terminate access for abuse or violation of these terms.
4. Billing and Subscriptions
Paid plans (Pro, Studio, Agency, Enterprise) are billed through Polar. Subscription terms, trials, renewal, and cancellation are governed by Polar's checkout and customer portal. You may cancel in accordance with your plan; we do not refund partial periods unless required by law. Free tier limits (e.g. transcription minutes, export formats) are described on our pricing page and may change with notice.
5. Intellectual Property and Data Ownership
You retain full ownership of your content (audio, video, transcripts). You grant Wisprs a limited license to process, store, and transmit your content only as necessary to provide the Service. We do not use your content to train AI models. Our software, branding, and documentation are our property; you receive no rights to them except the right to use the Service under these terms.
6. Disclaimer of Warranty
The Service is provided "as is." We do not warrant that the Service will be uninterrupted, error-free, or that transcription or other outputs will meet any particular accuracy or quality level. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
7. Limitation of Liability
To the maximum extent permitted by law, Wisprs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months before the claim.
8. Termination
We may suspend or terminate your access for violation of these terms or for any reason with notice. You may stop using the Service at any time. On termination, your right to use the Service ceases; we may retain and delete data in accordance with our Privacy Policy and Data Protection information.
9. Governing Law and Contact
